These Terms of Use ("Terms") govern your access to and use of medicaidplanningadvisory.com (the "Site") and the educational and informational services offered through it. The Site is operated by Medicaid Planning Advisory ("MPA," "we," "us," or "our"), a brand and trade name of Medicare Assistant LLC, an Arizona limited liability company. Please read these Terms carefully. By accessing or using the Site, you agree to be bound by them.
By accessing or using the Site, submitting a form or survey, or otherwise communicating with us, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site. If you are using the Site on behalf of someone else — such as a spouse or aging parent — you represent that you are authorized to do so.
Medicaid Planning Advisory is an educational, lead-generation, and networking platform. We provide general information about long-term care and Medicaid eligibility planning, and — where appropriate and with your permission — we connect families with a coordinated network of independent fulfillment partners who design, implement, and assist with Medicaid planning and related services.
MPA itself does not design plans, implement strategies, sell financial products, or submit Medicaid applications. Those services are provided by separate companies described in Section 8.
Medicaid Planning Advisory is not a law firm and does not provide legal advice. Nothing on the Site or communicated by us creates an attorney-client relationship.
The information we provide is general and educational and is not a substitute for advice from a licensed attorney. Laws and Medicaid rules are complex and vary by state and change over time. If you need legal advice, you should consult a licensed elder law attorney in your state.
Medicaid Planning Advisory and its alliance partners are not affiliated with, endorsed by, or connected to the federal government, any state Medicaid agency, the Centers for Medicare & Medicaid Services, or any other government body. You are never required to use our services or any partner's services to apply for Medicaid — you may apply on your own, for free, directly with your state Medicaid agency.
All planning strategies used by our alliance partners are specifically permitted under current state and federal Medicaid eligibility rules. We do not advise or assist with fraudulent transfers, concealment of assets, or any activity that violates Medicaid law.
Content on the Site is provided for general informational and educational purposes only and does not constitute legal, tax, financial, investment, insurance, or accounting advice. Your situation is unique, and you should obtain advice from qualified professionals before making decisions about long-term care, asset planning, or Medicaid eligibility. You rely on Site content at your own discretion and risk.
The Site is intended for adults located in the United States. Medicaid Planning Advisory serves the 48 contiguous United States (Alaska and Hawaii are excluded). Not all services are available in all states, and service availability varies by partner organization and by state. Submitting an inquiry does not guarantee that services are available to you or that we or a partner will be able to assist you.
Every situation is different, and outcomes depend on facts and circumstances specific to you, as well as on rules that change and are applied by third parties such as state Medicaid agencies. We make no promise or guarantee regarding any particular result, including Medicaid eligibility or approval, the amount of assets that may be protected, timelines, or cost savings. Any examples, figures, or outcomes described on the Site are illustrative only and are not a prediction of your results.
MPA may introduce you, with your permission, to independent fulfillment partners, including Medicaid Success Select (plan design and Medicaid qualification), Medicare Assistant LLC (Medicare plan review), and InsurMart LLC (Medicaid-compliant financial products). Each partner is a separate business responsible for its own services, contracts, fees, and conduct. MPA does not control and is not responsible for the services, products, or advice provided by any partner.
The Site may contain links to third-party websites. Those sites are governed by their own terms and privacy policies, and we are not responsible for their content or practices.
By submitting your information through the Site, you agree that we may contact you by phone, email, and text message regarding your inquiry and how we may be able to help, consistent with our Privacy Policy. We will not share your information with a fulfillment partner unless you give us permission to do so. You may opt out of marketing emails at any time and may opt out of text messages by replying STOP. Standard message and data rates may apply.
The Site and its content — including text, graphics, logos, the Medicaid Planning Advisory name and brand, layouts, and compilations — are owned by Medicare Assistant LLC or its licensors and are protected by intellectual property laws. You may view and use the Site for your own personal, non-commercial informational purposes. You may not copy, reproduce, distribute, modify, republish, or create derivative works from the Site or its content without our prior written permission.
You agree not to:
Use the Site for any unlawful, fraudulent, or harmful purpose;
Submit false, misleading, or another person's information without authorization;
Attempt to gain unauthorized access to the Site, its systems, or other users' data;
Interfere with or disrupt the Site, introduce malware, or use automated tools to scrape or harvest data; or
Use the Site or its content to compete with us or for any commercial purpose without our written consent.
The Site and all content and services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory.
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Site will be uninterrupted, secure, error-free, or that information on it is accurate, complete, or current.
To the fullest extent permitted by law, Medicare Assistant LLC and Medicaid Planning Advisory, and their officers, members, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site or reliance on its content.
To the extent any liability is not otherwise excluded, our total liability for all claims relating to the Site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Medicare Assistant LLC and Medicaid Planning Advisory and their officers, members, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Maricopa County, Arizona will have exclusive jurisdiction and venue over any dispute, and you consent to personal jurisdiction there. Any claim must be brought within one year after it arises, to the extent permitted by law.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and your continued use of the Site means you accept the revised Terms. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site.
